HyperTech Servers Terms and Conditions

Welcome to our Terms of Service Guidelines. When you the “Customer” order or register for any services from HyperTech Servers YOU are required to keep up to date with changes in our policy and service guidelines. It is you’re responsibly to read our terms of service completely. If you do not understand any part of our terms please contact us at sales@hypertechservers.com for clarification.

1. Introduction

  1. These terms and conditions govern your use of the access and services of hypertechgaming.com or hypertechservers.com (the “Web Site”). Within this document, HyperTech Servers may be referred to as “the company” or “us” or “we.” These terms of service apply to all users (referred to as “you” or “the user”) of the Web Site and the services provided by the company. “Services” are defined as leased game servers, leased dedicated servers, forums or any other services provided by the company to the user.
  2. By selecting the “I agree” box next when placing an order for services with the company, you agree to be bound by the Terms of Service contained herein. If you wish to withdraw your consent, you may do so by sending an e-mail to billing@hypertechservers.com.
  3. We reserve the right to revise or amend these Terms of Service at any time and any manner. You should check the HyperTech Servers forums periodically for updates. If you have any questions about the Term of Service, please contact us at sales@hypertechservers.com or by calling us at 1.800.517.3521. You may only access the Services by agreeing to these Terms of Service. If you do not agree with these Terms of Service or with any updated Terms of Service, please leave the Web Site and do not order, and discontinue all Services provided by us.

2.   72 hour Money-Back Guarantee

  1. The company offers a 72 hour money back guarantee with respect to the Services. If you cancel Services (see section 3.c) before the end of the 72 hour period after the activation of your Services, you may receive a full refund of your payment, excluding any setup fees (America's Army Honor- See section 2.b). As a courtesy, we ask that you allow us to work with you to solve any problems you are experiencing. Cancellations beyond the 72 hour period after activation are bound by the refund policy.
  2. America's Army Honor requires licensing fees to be paid to host your server. Due to this fact, all America's Army Honor refunds will be given minus the licensing cost.

3.  Payment

  1. All payments are to be made on a subscription basis via PayPal at www.PayPal.com. If you have any questions regarding billing, please contact billing@hypertechservers.com. PayPal accepts Visa, MasterCard, American Express, and Discover cards.
  2. You may change, upgrade, or downgrade your service at any time. Additional fees may apply for service upgrades if you are upgrading service in the middle of your current billing cycle.
  3.    New customers: If for whatever reason you do not wish to keep service with us, you can request a cancellation within your first 72 hours of service. Since we do not charge a set-up fee, you will be reimbursed your monthly fee less $20.00 for game servers. If cancellation of service is requested after 72 hours, no refunds will be issued.
  1. Existing customers: You may cancel your service at any time. In order to cancel, you must contact us no later than 3 days prior to your next billing date. No refunds will be awarded for cancellations made after your billing date. Your service will continue until the billing cycle ends.

4. Correct User Information

  1. To access our Web Site or our Services, you may be asked to provide registration details or other information. It is a condition of your use of our Services that all information you provide will be correct, current, and complete.
  2. If we believe that the information you provide is not correct, current, or complete, we have the right to refuse you access to our Services and to terminate or suspend your access at any time with no refund due.

5.   Customer Responsibilities

  1. You are responsible for the upkeep of your server, including but not limited to adding   mods, maps, game play related files and server configuration modifications. The Company will assist you in this effort, however we cannot guarantee support for mods, maps and other game play related files. If your server is not operational, you are required to notify us as soon as possible via a support ticket found on our web site or. We do not monitor game servers; however our server management system will attempt to restart servers if they stop.
  2. We will patch your server as needed by the game designers at no extra charge. Game servers are set up with the base install according to the game type ordered. If at any time you render your server inoperable, which causes us to do a RE-INSTALL, a $20.00 charge will be issued. The price you pay when ordering the service will remain in effect for the length of your service.

6.   Game Server Software Liability.

  1. We will not be responsible for, and you will indemnify us and hold us harmless against, any liability for any costs, expenses, claims or damages whatsoever which arise from or relate to game server software and your use of the Services (including without limitation, such items which arise from claims by third parties).

7.   User Names and Passwords.

  1. You are solely responsible for keeping your username and password secret. You must immediately notify us if you believe your username or password security has been breached. We will have no obligation to safeguard your username and password. Membership and passwords may not be assigned, transferred, or sold to a third party. HyperTech Servers and its affiliates disclaim any and all liability arising from fraudulent entry and use of our services. If a user fraudulently obtains access, we may terminate membership immediately and take all necessary and appropriate actions under applicable federal, state, and international laws.

8.   Language

  1. Abusive or offensive language will not be tolerated by users and guests on the forums, support tickets or phone. Any violation of this policy will result in a suspension of site access or such other action as may be reasonably required by the Company to ensure compliance.

9. FTP

  1. FTP access is not to be used to run a file site or for file storage. All users of our service are responsible for their files and the content of their servers. Game Server installs come as a basic setup. Additional files and add-ons must be applied by the customer. Any time you make changes to your files, please test those changes on your local computer system first. Please change your files with care.
  2. We are not responsible for the files in your game server directories after your game server account is activated.

10.   Data Security and Backups.

  1. You are solely responsible for any and all backups of your data. Hypertechservers.com will incur no liability for any loss of data due to hardware or software failure, or for any other reason. Hypertechgaming.com highly recommends keeping backup copies of files, configurations, mods and other important files on your local computer.

11.   Pricing Subject to Change

  1. Prices for the Services are subject to change without notice. In order to be eligible for new lower pricing you must submit a support ticket with the request to be changed to the lower rate.

12. America's Army Honor - INTELLECTUAL PROPERTY NOTICE "AAHONOR" and "Pragmatic Honor Provider" and their corresponding logos are copyrighted and/or trademarked by Pragmatic Solutions, Inc. "America's Army", "Honor", and "America's Army Honor" and their corresponding logos are copyrighted and/or trademarked by the Department of the Army. Logos and/or marks may not be used without expressed written permission from Pragmatic Solutions, Inc. or the Department of the Army respectively.

13.   All information pertaining or relating to Services, support or agreements between the company and the client sent via email, support ticket or otherwise stated is confidential information between the company and the customer or respective parties unless otherwise noted in writing. It is strictly prohibited to exchange, post, email, or transmit in any form without written consent of the company or company legal parties.

14.   Disclaimer of Warranties - THE COMPANY MAKES AND YOU RECEIVE NO EXPRESS WARRANTIES WITH REGARD TO THE SERVICES EXCEPT THOSE SPECIFICALLY SET FORTH HEREIN. ANY STATEMENTS OR REPRESENTATIONS ABOUT THE SERVICES ON THE WEBSITE OR IN ANY COMMUNICATION WITH YOU CONSTITUTE TECHNICAL INFORMATION AND NOT AN EXPRESS WARRANTY OR GUARANTEE. IN ADDITION, THE COMPANY SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MECHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, THE COMPANY DOES NOT WARRANT THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE SERVICES HAVE ANY SECURITY FEATURES.

15.   Final Note - Failure to comply with all current and future Terms of Service will result in termination of your account and/or service interruption. We will immediately terminate your server if we find it is in violation of our Terms of Service. The server will remain shut down until the account holder ensures us his/her game server will comply with our Terms of Service. If a user has excessive violations, then his/her account will be terminated without refund.
